Terms of Service
These terms are the agreement between you and us for using the hosted FamilyWell service. We've tried to keep them readable. The callouts highlight the parts people most often need to know.
1. Who we are
FamilyWell is operated by DRAGOMIR M BOGDAN-VIOREL PFA, a sole proprietorship registered in Romania, with its registered address at Sat Pietrosani, Comuna Puchenii Mari, Nr. 816, C1, Prahova, Romania ("FamilyWell", "we", "us").
These Terms of Service ("Terms") apply to the hosted FamilyWell app at familywell.co and to this website, familywell.org, including the module requests board (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you don't agree, please don't use the Service.
How we handle personal data is explained in our Privacy Policy, which forms part of these Terms.
2. The service
FamilyWell is a family organiser. Each family gets a shared space with modules that members can switch on, including shared to-do lists, shopping lists, spending and expenses, notes, recipes, birthdays, a calendar, contacts, projects, inventory and vehicles. Data is organised per family and shared between members according to the family's sharing settings.
The Service also includes:
- a public demo family that anyone can open to try FamilyWell;
- the module requests board on familywell.org, where signed-in families post and vote on ideas (Section 8);
- optional AI features that suggest categories or other details (Section 9);
- an optional connection that lets AI assistants you authorise work with your family (Section 10);
- optional web push notifications.
We keep improving FamilyWell, so modules and features may be added, changed or retired over time (Section 15).
3. Accounts
You must be at least 16 years old to create an account. You can sign up with an email address and password, or with Sign in with Google or Sign in with Apple where offered. We ask you to verify your email address.
Give accurate information, keep your password safe, and tell us promptly at hello@familywell.org if you think someone else has accessed your account. You are responsible for activity under your account. Each account is for one person and can't be transferred.
Emails from us. By creating an account you agree that we may email you about your account and about the product itself: updates on new features, changes to how FamilyWell works, and important notices (for example about security, billing or changes to these Terms). These emails are about the product's functionality; they are not commercial or marketing offers. You can unsubscribe from product updates with the link in any of them; account, security and billing emails are part of the Service and keep coming while you have an account. We only send marketing emails (offers or promotions beyond how the product works) if you separately opt in, and you can withdraw that at any time.
4. Families and members
You can create a family and invite others to it, or join a family you've been invited to. Whatever you add to a family is visible to its other members, and they may be able to change it, depending on the family's sharing settings. Only invite people you're happy to share that family's data with.
Children. Children under 16 cannot create their own account. A parent or guardian can create and manage a family profile for a child. The parent or guardian is responsible for that profile, for what is recorded about the child, and for the child's use of FamilyWell.
Families often store details about people outside the family (a relative's birthday, a mechanic's number). You are responsible for having a good reason to store that information and for keeping it to what the family needs.
Anything entered in the public demo family can be seen by anyone. Don't put real personal information there.
5. Plans, payment and cancellation
The hosted plan is charged per family: USD 5 per month or USD 45 per year. One subscription covers every member of that family. Taxes, where they apply, are shown at checkout.
Payments are processed by Stripe through Stripe Checkout. We never see or store your card details. Subscriptions renew automatically at the end of each billing period until cancelled, and you are charged at the start of each period.
Cancellation. You can cancel at any time from the billing page in the app, which opens the Stripe customer portal. Your plan stays active until the end of the period you've paid for and is not renewed after that. Apart from the right of withdrawal in Section 6, we don't refund the unused part of a period, but if something went wrong, write to hello@familywell.org and we'll look at it case by case.
Price changes. We may change prices. For existing subscribers we will give at least 30 days' notice before a new price applies, so you can cancel before it does.
Failed payments. If a renewal payment fails, Stripe may retry it. If it still can't be collected, paid features may be paused until payment succeeds. Your data is not deleted because of a failed payment.
Self-hosting is never charged. If you run FamilyWell on your own server, you don't pay us anything and these billing terms don't apply.
6. Right of withdrawal
If you are a consumer in the European Union, you may withdraw from a subscription within 14 days of purchase without giving a reason, under Romanian Government Emergency Ordinance (OUG) 34/2014, which implements EU Directive 2011/83/EU.
Immediate access. By subscribing, you ask us to start the Service straight away. If you withdraw within the 14 days, you may be charged a proportionate amount for the days of service you had before withdrawing, calculated pro rata from the subscription price. We refund the rest within 14 days of receiving your withdrawal notice, using the same payment method.
To withdraw, email hello@familywell.org before the 14-day period ends.
7. Your content and acceptable use
You own your content. Everything you and your family put into FamilyWell (lists, notes, recipes, photos, documents and so on) stays yours. You give us only the limited, non-exclusive licence we need to store, process, back up and show it to the people you share it with, in order to run the Service. We claim no other rights over it.
You are responsible for the content you add and for having the right to add it. You agree not to:
- upload anything unlawful, or anything that infringes someone else's rights, including copyright and privacy;
- use FamilyWell to harass, threaten or harm anyone;
- upload malware or try to break, overload, probe or get around the security of the Service;
- access other families' data without permission, or scrape the Service;
- resell the hosted Service or use it to run a service for others;
- use the Service in a way that breaks applicable law.
We apply rate limits and may remove content or limit access where it is needed to protect the Service or other users, or where the law requires it.
8. The module requests board
Requests and comments are public. Anything you post on the module requests board can be read by anyone, along with your family's display name and, if you add one, your city. Don't post private information.
Posts must be about FamilyWell and follow the acceptable use rules in Section 7. Posts are checked automatically for spam and abuse, and we may edit for formatting, merge duplicates, hide or remove posts at our discretion. Public requests may also be copied to the FamilyWell GitHub repository as issues.
When you post an idea, you allow us to use, discuss, build and publish it, in FamilyWell or elsewhere, without owing you anything beyond any reward we have publicly announced for that request. Rewards described on the board (such as free months on the hosted plan) are offered on the conditions stated there; which requests are shortlisted or shipped is our decision.
9. AI features
Some optional features use AI services (Google Gemini and TypeSafe) to suggest categories or other details for content you submit to that feature. Suggestions are generated automatically and can be wrong. Check them before you rely on them, especially for money. To the extent permitted by law, we are not responsible for decisions you make based on an AI suggestion.
10. AI assistants
You can connect an AI assistant (such as Claude or ChatGPT) to FamilyWell over the Model Context Protocol (MCP). This section applies only if you choose to.
Off by default, and under your control. No assistant can reach your data unless you connect it yourself through a consent screen. There you choose one family and, module by module, whether the assistant may only read or also make changes. You can revoke a connection at any time in the app, and it stops working immediately.
Each permission does what it says. If you allow an assistant to change a module, it can add, edit and delete items in that module for that family, and other family members will see those changes. Assistants are run by their own providers, not by us, and we can't control how an assistant interprets your requests. An assistant may misunderstand you or act on instructions hidden in content it reads.
To the maximum extent permitted by law, we are not liable for actions an assistant takes within the permissions you granted. Deleted items can usually be restored from the trash for 30 days. Content an assistant adds counts as your content under Section 7. The assistant provider's own terms apply to your use of the assistant (Section 11). We may limit or suspend a connection that abuses the Service.
11. Third-party services
Some parts of the Service rely on, or connect to, third-party services, including Stripe (payments), Google and Apple (sign-in), AI assistant providers you connect, and GitHub (public requests). Your use of those services is governed by their own terms, which you are responsible for following. We are not responsible for the availability or behaviour of third-party services.
12. Source code and self-hosting
FamilyWell's source code is published on GitHub under the PolyForm Noncommercial License 1.0.0. Your rights to use, copy and change the code come from that licence, not from these Terms.
These Terms don't cover self-hosted installs. If you run your own copy of FamilyWell, you are responsible for it, including the data stored in it and any legal obligations towards the people who use it. If you use an install that someone else runs, your agreement is with them. We don't operate, monitor or support self-hosted installs and are not responsible for them.
13. Intellectual property
The FamilyWell name, logo and the design of this website and the hosted Service belong to DRAGOMIR M BOGDAN-VIOREL PFA. The source code is available under the licence described in Section 12. Nothing in these Terms gives you a right to use the FamilyWell name or logo in a way that suggests we endorse you or your product.
Claude, ChatGPT, Google, Gemini, Apple, Stripe, GitHub and other product names mentioned on this site are trademarks of their respective owners and are used only to identify them. FamilyWell is an independent service and is not endorsed by those companies.
14. Suspension and termination
You can stop using FamilyWell and delete your account at any time from the app's settings, or by emailing us. If you cancel a paid plan, Section 5 applies.
We may suspend or close an account, or remove a family's access, if it seriously or repeatedly breaks these Terms, if the law requires us to, or to protect the Service or other people. Where it's reasonable and lawful, we'll tell you first and give you a chance to fix the problem and export your data. In serious cases (for example illegal content, abuse or a security threat) we may act without notice.
Deleting your account removes your personal data as described in the Privacy Policy. Content you added to a family that still has other members may stay part of that family's records.
15. Availability and changes
We work to keep FamilyWell available and your data safe, including with regular backups, but we can't promise the Service will be uninterrupted or error-free. We may carry out maintenance, and we may change, add or retire features or modules.
If we decide to discontinue the hosted Service, we will give you reasonable notice and a way to export your family's data. Because the source code is public, you will also be able to self-host it.
16. Limitation of liability
The Service is provided "as is" and "as available", without warranties beyond those that the law requires.
To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount your family paid us in the 12 months before the claim, or (b) EUR 50. We are not liable for indirect or consequential losses, such as lost profits or lost opportunities.
Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct, and nothing affects your statutory rights as a consumer.
17. Governing law and disputes
These Terms are governed by Romanian law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live. If we can't resolve a dispute amicably, it will go to the competent courts of Prahova County, Romania, or, for consumers, the courts of the consumer's domicile where the law allows it.
Consumers can also contact:
- ANPC, the Romanian National Authority for Consumer Protection;
- ANPC SAL, alternative dispute resolution.
18. Changes to these terms
We may update these Terms as FamilyWell changes. For material changes we will tell you by email or with a notice in the app at least 30 days before they take effect. If you don't agree with the new Terms, you can cancel and delete your account before then. If you keep using the Service after the change takes effect, the new Terms apply.
